Terms of Service

1. Who this agreement is with

FARAGHA is provided by [Business/legal entity name], trading as CLICKMTAA ("we," "us," "our"), [registered business number/KRA PIN]. By installing or using FARAGHA, you ("you," "the user") agree to these Terms of Service.

2. What FARAGHA is

FARAGHA is a web application (installable as a Progressive Web App) that converts M-PESA confirmation SMS messages into shareable receipt images with the account balance redacted. It runs primarily on your own device.

Free tier — available to everyone, with no account required: generating redacted receipts, downloading, copying, and sharing them, and offline use.

Business tier — Ksh 100 per month, unlocked via M-Pesa payment: custom business branding on receipts, tagging contributions, and group contribution reports.

3. Eligibility

You must be able to form a binding contract under Kenyan law to use the paid tier of FARAGHA. If you are using FARAGHA on behalf of a group (a chama, committee, or business), you are personally responsible for these terms regardless of who ultimately benefits from the contribution records you generate.

4. Subscriptions and payment

• The Business tier costs Ksh 100 per 30-day period, charged via M-Pesa STK Push at the time you subscribe or renew.
• This is not an automatically recurring charge. M-Pesa's STK Push does not support automatic recurring billing. Each renewal requires you to actively approve a new payment prompt on your phone. We will never charge you without you entering your M-Pesa PIN for that specific charge.
• If your subscription lapses, FARAGHA automatically reverts to the free tier. Any receipts or tags you created while subscribed remain stored on your device and become accessible again immediately if you renew — nothing is deleted for non-renewal.
• Prices may change with notice posted on this website (faragha.clickmtaa.com). Price changes will not apply retroactively to a period you've already paid for.

5. Refunds

Because the Business tier is billed in advance for a 30-day period and unlocks immediately upon payment, payments are generally non-refundable once the subscription has been activated. If you believe you were charged in error — for example, a duplicate charge, or a charge that didn't unlock the Business tier — contact us via WhatsApp (0118 058190) or [email protected] with your M-Pesa transaction code and we will investigate and correct genuine errors.

6. Acceptable use

You agree not to:

• Use FARAGHA to create receipts that misrepresent a transaction that did not occur, or to alter transaction amounts, dates, or codes beyond the automatic balance redaction FARAGHA performs
• Attempt to interfere with, reverse-engineer, or abuse the payment or licensing systems
• Use FARAGHA for any unlawful purpose, including facilitating fraud

FARAGHA redacts information from messages you already lawfully possess; it does not fabricate transaction details, and using it to do so is a violation of these terms as well as likely a separate legal matter between you and whoever you present a falsified receipt to.

7. Your content and data

Receipts, tags, and related records you create are stored on your own device only — we do not receive, store, or have access to this content on any server. You are responsible for backing up this data (FARAGHA provides an export/backup feature for this purpose) — if your device is lost, damaged, or its storage is cleared, and you have not made a backup, we cannot recover that data for you, because we never had it.

8. Intellectual property

The FARAGHA name, the CLICKMTAA name, and the app's design are owned by us. You're welcome to use the app and share the receipts it generates — this doesn't grant you rights to our branding, source code, or design beyond that ordinary use.

9. No warranty; limitation of liability

FARAGHA is provided "as is." We work to keep it accurate and reliable, but:

• We do not guarantee FARAGHA will correctly parse every possible M-PESA message format, now or in the future, if Safaricom changes their message formats.
• We are not responsible for disputes, losses, or consequences arising from how you or anyone else uses a receipt FARAGHA generates.
• To the maximum extent permitted by Kenyan law, our total liability to you for any claim relating to FARAGHA is limited to the amount you paid us in the 3 months before the claim arose (which, for free-tier users, is zero).

Nothing in these terms limits liability where Kenyan law does not permit it to be limited.

10. Termination

You may stop using FARAGHA at any time by uninstalling it. We may suspend or terminate access for violations of these terms, particularly the acceptable use section above. If we terminate your Business tier access for a violation, no refund is owed for the remaining subscription period.

11. Changes to these terms

We may update these terms as the product changes. Material changes will be noted with an updated "Last updated" date above. Continued use after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of Kenya. Any disputes will be subject to the jurisdiction of Kenyan courts.
